Florida Test Prep — Terms of Service

These Terms of Service ("Terms") govern your use of services provided by Florida Test Prep LLC ("Florida Test Prep," "we," "us," or "our"). By enrolling, booking a session, providing your mobile number, or otherwise using our services, you agree to these Terms.

1. Scope of Service

Florida Test Prep provides specialized SAT/ACT coaching and strategy sessions. While we provide expert instruction and proprietary materials, results depend on student engagement, practice, and consistency.

2. No Guarantee of Results

By enrolling, you acknowledge that Florida Test Prep cannot guarantee specific score increases or admission to specific colleges. Test scores are influenced by many factors outside of our control, including student performance on test day.

3. Cancellation & Rescheduling

To respect our team's time and ensure all students have access to sessions:

24-Hour Notice: Any rescheduling or cancellation must be made at least 24 hours in advance.

Late Arrivals: If a student is more than 15 minutes late to a Zoom session, the session will be considered a "no-show" and may be forfeited without a refund.

4. Intellectual Property

All worksheets, video recordings, and Success Plan documents provided are the exclusive property of Florida Test Prep LLC. These materials are for the individual student's use only and may not be shared, resold, or redistributed.

5. SMS / Text Messaging Terms

This section describes our SMS messaging program, your consent, and your rights. It applies to all text messages sent by or on behalf of Florida Test Prep LLC.

5.1 Program Description

Florida Test Prep LLC operates an SMS messaging program for current, former, and prospective students (and their parents or legal guardians) for the purposes described below. Messages are sent using automated technology, including an automatic telephone dialing system, and may also include one-to-one messages from our staff.

5.2 How You Opt In

You opt in to receive SMS messages from Florida Test Prep by checking the SMS consent box during enrollment, booking, or sign-up on our website at https://fltestprep.com. The checkbox states:

"By checking this box, I agree to receive recurring automated promotional and personalized marketing text messages (e.g., homework reminders, class alerts) from Florida Test Prep at the cell number used when signing up. Consent is not a condition of any purchase. Reply HELP for help and STOP to cancel. Msg frequency varies. Msg & data rates may apply. View our Privacy Policy and Terms of Service."

Consent is not a condition of purchase. You can enroll in and use Florida Test Prep services without agreeing to receive SMS messages.

5.3 Types of Messages You May Receive

Once opted in, you may receive recurring SMS messages including:

Scheduling confirmations and reminders for calls, classes, and tutoring sessions

Homework reminders and class alerts

Updates related to your inquiry or enrollment (program options, next steps, logistics, and access links)

Important service notices (e.g., schedule changes, cancellations, instructor updates)

Account, billing, and payment-related notifications

Promotional, educational, or personalized marketing messages related to SAT/ACT prep, new programs, and offers

5.4 Message Frequency

Message frequency varies based on your enrollment status and class schedule. Active students typically receive up to 15 messages per month. Prospective students or those between enrollments typically receive fewer messages.

5.5 Message & Data Rates

Message and data rates may apply. You are responsible for any charges from your wireless carrier related to sending or receiving SMS messages.

5.6 Opt-Out (STOP)

You can opt out of SMS messages at any time by replying STOP to any text message from us. After you reply STOP, you will receive a single confirmation message acknowledging your opt-out, and no further SMS messages will be sent unless you opt in again. To opt back in, reply START or sign up again through our website.

5.8 Carrier Liability

Mobile carriers (including AT&T, T-Mobile, Verizon, and others) are not liable for delayed or undelivered messages. SMS delivery is subject to the availability and capacity of your wireless network.

5.9 Age Restriction (18+)

By opting in to receive SMS messages, you represent that you are at least 18 years of age, or that you are the parent or legal guardian of the student and are authorized to provide consent on the student's behalf.

5.10 No Sharing of Mobile Information with Third Parties

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors that support our SMS program (for example, our SMS messaging platform, CRM, and customer support providers) is permitted only to the extent necessary to deliver the messaging service. All other categories of personal information are governed by our Privacy Policy and are subject to its sharing restrictions.

5.11 Privacy

Your phone number and any information you provide in connection with SMS messages are handled in accordance with our Privacy Policy at https://fltestprep.com/privacy. We do not sell or rent your mobile number or SMS opt-in data.

6. Limitation of Liability

Florida Test Prep LLC's total liability for any claim arising out of or related to our services is limited to the total amount paid by the client for the specific program in question. Florida Test Prep is not liable for any indirect, incidental, consequential, or punitive damages.

7. Privacy Policy

Your use of our services, including SMS communications, is also subject to our Privacy Policy, available at https://fltestprep.com/privacy. Please review it for details on how we collect, use, share, and protect your information.

8. Changes to These Terms

We may update these Terms of Service from time to time. Material changes will be posted on this page with an updated effective date. Your continued use of our services after such changes constitutes your acceptance of the revised Terms.
